OF AN ADMINISTRATIVE <br /> DECISION APPEAL A2-88 <br /> DFCISION: The appeal is granted and lots 11 and 12 of Block <br /> 34, of the Pinehurst Division "B", Everett, <br /> Washi.naton, are certified as non-conforming lots <br />� and a building permit should be issued. <br /> INTROCUCTION 2�X g I • ''' `^ ��� 7'' <br /> On March 8, 1988, the Everett Planning Director issued an <br /> opinion that lots 11 and 12 of Block 34 , the Plat of Pinehurst <br /> Division "B", could not be certified as a "non-conforming lot" <br /> and that Blue Bay, Inc. , 1429 Broadway Avenue, Everett, <br /> Washington, (hereinafter refecred to as Appellant) cannot <br /> . obtain a b��ilding permit for 3evelopment of the lots . The <br /> common description of the property involved is 2102 Jackson <br /> Street, Evere�t Washington. � <br /> . On March 10, 1988, the Appellant submitted an appeal to the <br /> City of Everett Hearing Examiner of the Everett Planning <br /> Director 's determination . A heariig on the appeal was held <br /> beEore the Everett Hearing Examiner on April 28 , 1908 . <br /> Subsequent to the appeal the City of Everett requested and was <br /> granted permission to respond to the legal arguments presented <br /> by the Appellant at the heacing .
