INTROCUCTION 2�X g I • ''' `^ �� 7'' On March 8, 1988, the Everett Planning Director issued an opinion that lots 11 and 12 of Block 34 , the Plat of Pinehurst Division "B", could not be certified as a "non-conforming lot" and that Blue Bay, Inc. , 1429 Broadway Avenue, Everett, Washington, (hereinafter refecred to as Appellant) cannot . obtain a b��ilding permit for 3evelopment of the lots . The common description of the property involved is 2102 Jackson Street, Evere�t Washington. � . On March 10, 1988, the Appellant submitted an appeal to the City of Everett Hearing Examiner of the Everett Planning Director 's determination . A heariig on the appeal was held beEore the Everett Hearing Examiner on April 28 , 1908 . Subsequent to the appeal the City of Everett requested and was granted permission to respond to the legal arguments presented by the Appellant at the heacing . The Appellant was given an opportunity lo rebut the City's legal arguments .
