1 <br /> , � � r� � �on � � <br /> IN THE MATTER OF THE ALLEGED FEB 2 2 � D <br /> VIOLATION OF ALBERT PIGNATARO VIOLATION #142-93 <br /> 94 <br /> CITY OF EVERETT <br /> ORDER Public Warks Depf. <br /> On November 3, 1993, the Hearing Examiner of the City of Everett is�ued a decision in the <br /> above referred to case. The owner�f the property at 2605 - 19th Street, Everett, <br /> Washington, AlbeR Pignataro, was given three options for reconverting of the structure on- <br /> site. The three options, as steted in the November 3, 1993, decision, were: <br /> 1. Resoive any disputes with regard to the purchase of the property that Pignataro <br /> may have with his mortgage compeny, title insurance company, or real estate <br /> company regarding the purchQse of the subject property. If some relief is granted, <br /> Pignataro shall be required to reconvert the accessory stn�cture into a <br /> garagelrecxeation room. Pignstaro must commence a legal action to seek relief no <br /> later than March 30, 1994. If this legal relief is iot initieted by that date, it will be <br /> presumed it thE! rvill not be obtained. In addi' �n, all legal relief shall be completed <br /> by October 31, 1�94. If legal relief is sought, but not completed, this matter will be <br /> reopened by the Hearing Examiner. <br /> 2. Apply for a variance. The variance will be processed aa:ording to the lews of the <br /> City of Everett. Such application of a variance must be processed and reviewed no <br /> later than March 30, 1994. <br /> 3. Apply for a short subdivision of the subject property. Such application must be <br /> submitted no later then March 30, 1994. <br /> Subsequent to the Hearing 6caminers decision, the City of Everett Planning Department <br /> submitted a Motion for Reconsideretion setting forth that the opiions as steted by the <br /> Hearing Examiner were impossible to perform. In addition, an adjoining property owner, <br /> Don Lundstrom, retei�ed the sE+rvices ot an attomey who asked for input into the metter. <br /> As a result of the City's Motion Tor Reconsideratian and the fact that tho adjoining property <br /> owner retained the services of an atturney to protect his interests, it was determined that <br /> the matter should be reopened. <br /> A hearing on the reopening of the case was held before the Hearing Examiner on February <br /> 3, 1994. <br /> At the reopened he�ring the following presented testimony and evidence: <br /> Jim Hanson, Planning Staff <br /> Albert Pignataro <br /> 2605 - 19th SVeet <br /> Everett, WA 98201 <br />
