That there have been exceptional or extraardinary circumstances or <br /> conditions applying to the sub�ect property or as to the intended use i <br /> thereof that do not apply generally to other properties in the same <br /> I vicinity or zone. ' <br /> I I <br /> Finding: City zoning code defines "Gross Floor Area Ratio" as the <br /> sum of all the floors of a building divided by the lot area. The � <br /> City feels a more reasonable way to limit lot coverage would be ta <br /> consider the foot�rint of the buildiag as the basis for figuring <br /> .gross floor area ratio since there is already a height limitation <br /> that controls the number of flours. In the past, the gross floor <br /> area ratio has not been uniformly enforced; however� the City feels <br /> that rather than disregarding the code it is more appropriate to <br /> oonsider applications for vaciance on an individual basis until the <br /> i zoning code is ehangci. <br /> II in addition� over 50A of the lots in this plat are much larger than <br /> II Lot /3 and so would allow a much larger home without exeeeding the <br /> gross floor area ratio. <br /> i <br /> Conclusion: The varianee as proposad by the Applicant appears to be <br /> a reasonaUle request. <br /> 2. That such variance is necessary for tha preservation and en�o}rment of <br /> a s��bstantial property right of the appellant possessed by the oxners <br /> �I of other properties in the same vieinity or zone. <br /> II Finding: 'fhe Board of Ad,justment has granted other requests for <br /> variance from gross floor area ratio and the City will continue to <br /> i' recommend doing so until the zoning code is changed. <br /> II Conclusion: The variance uould allow a property right possessed by <br /> other owners. <br /> 2661F <br />
