Zhe application is for t2�e apQroval of subdivision alterations of the <br /> Plat of Crestwood. 4he requested alterations are to extinguish a 15' <br /> wide aocess easement across the southerly portion of lot 17 which now <br /> provides an alternative means of access to lot 18. In addition, the <br /> Applicant requested that the revised building setbacks for lot 17 be <br /> established consistently �ith the R-1 zoninq requirements. <br /> 2. In the City of �erett and State of Washington, the provisions of RCW <br /> 58.17.215 govern the alteration of all existing subdivisions. 'it�at <br /> subdivision alteration is adequately described as set forth in the <br /> Findings of this doc�anent. <br /> 3. 111e Plat of Crestwood and the Declaration of the Restrictive Covenants <br /> of Crestwood were filed at approximately the same time acxi are bindinq <br /> for the property. <br /> 4. _ction 2(C) of the Declaration of Restrictive Covenants of Crestwood <br /> �estrict the location of buildings as shown on the final plat map. 'ihe <br /> re�trictions include a 20' setback on lot 17. <br /> 5. Section 3 of the Restrictive Oovenants of CrestWood requires that the <br /> Buildinq Fhvelope and the View Orientation Plan aze pnrt of the <br /> covenants. Q� the Buildinq F}rvelope and View Orientation Plan, a 20' <br /> setback fraa the southerly boundary line of lot 17 is shown. <br /> 6. 7tie Applicant did not provide siqnatures of the majority of those <br /> persons having an ownership interest in lots, tracts and parcels, sites <br /> or divisions in the subject subdivision or portion to be altered <br /> requestinq foc the extinguishment of the access easement or the <br /> reduction of the zoning standazds to R-1 standazds for lot 17. <br /> 7. �e application for the alterations will result in the violation of <br /> recorded oovenants. In order to alter the subdivision, the Applicant <br /> must provide an agreempnt signed by all parties subject to the <br /> covenants. 7�e Applicant has failed to provide such an aqree�nent. <br /> 8. 'Ihe Appiicant has not met the requirements of RCW 58.17.215. <br /> DF�ISION <br /> Hased upon the precedinq Findings of Facts and Conclusions, the testimony and <br /> evidence sutmitted at the public hearing, and upon the impressions of the <br /> Everett Heazing F]raminer of the site view, it is hereby ordered that the <br /> requested subdivision alteration for the Plat of Crestwood is clenied. <br /> Specifically, th� following alterations aze denied: <br /> 1.
