Everett Mall Way, EVerett WA, <br /> ; hereinafter referred to as "Applicant," for a varianee from E.M.C. to allorr: <br /> Construetion oP a Single Family dwelling that xould have a <br /> floor area of .33 instead of .30. <br /> on the folloxing de�aribed proparty (legal description, indent) <br /> Lot t3, Crestwood �709- �,(�rE�1eO� L� <br /> ; The Board of Ad�ustment� folloxing a public hearing on said applioation held <br /> i on (date) Novemer 3 and further having reviexed all testimony, makes the <br /> folloxing Findinga� Conclueions and Order: <br /> i FINDINGS AND CONCLlT3I0NS: <br /> I 1. That there have been exceptional or extraordinary airnumstanoes or <br /> nonditions applying to the sub,�ect property or se to the intended use I <br /> thereof that do not apply generally to othar properties in the same I <br /> vicinity or zone. � <br /> a. In the past, the gross floor area ratio hae not been I <br /> � uniformly enforeed; hovever, the City feeln that rather than <br /> disregarding Che code it is more appropriata to conaidar <br /> � applioations for variance on an indivit�!al basis until the <br /> i zoning oode is ehanged. <br /> ' b. Conolusion: The varianee as proposed by the Applicant appears <br /> , <br /> to be a reasonable request. <br /> 2. That sueh varianee is necessary for the preservation and an,�oyment of <br /> a substantial property right of the appellant posaessed by the oti+ners <br /> o: other properties in the same vicinity or zone. <br /> a. Finding: The Board of Ad�ustment has granted other requests <br /> for varianee from gross floor area ratio and the City xill <br /> oontinue to recommend doing so until the zoning code is ehanged. I <br /> b. Conclusion: The variance would allow a property right <br /> possessed by other oWners.
