CITY OF EVERETT <br /> SPECIAL PROPERTY USE PERMIT #15-85. <br /> 4928 & 4930 Elm Street <br /> WHEREAS, there was filed with the City of Everett Planning Department <br /> on November 8, 1985, an application for a Special Property Use Permit, under. <br /> Everett Municipal Code (E.M.C.) 19.58.010, by -Janet Malott at 4928 and 4930. <br /> Elm Street described as follows: <br /> A SPU Permit to allow the applicant to operate a pre-school and day care for al <br /> maximum of 28 students on-site at one time. <br /> AND, WHEREAS, after proper notice was given as required by law, a <br /> public hearing was held on January 23, 1986, before the City of Everett Land <br /> Use Hearing Examiner; and <br /> WHEREAS, after consideration of the evidence presented by the <br /> Applicant; evidence elicited during the public hearing; and as a result of a ; <br /> personal inspection of the subject property and surrounding areas; the Hearing <br /> Examiner made findings and conclusions and rendered a decision on February 6, <br /> 1986, to grant the Special Property Use Permit with the following conditions: <br /> { <br /> 1. The pre-school/day care is limited to 28 children on-site at one time. <br /> 2. The Applicant must secure all permits and approvals of the Department <br /> of Social and Health Services of the State of Washington. <br /> • <br /> 3. A City business license must be secured by the Applicant before <br /> occupancy. <br /> 4. The play area shall be defined and fenced to meet all DSHS requirements. <br /> 15. A pick up-drop off area and off-street parking shall be required. <br /> Parking improvements to the site must be approved by the Everett <br /> i' <br /> Planning Department and Public Works Department prior to occupancy. <br />. 6. 4928 Elm Street shall remain single family residential, owner <br /> occupied. It will not be used as the pre-school day care facility. <br /> 7. Any use of 4930 Elm Street as a pre-school/day care facility, other <br /> than by the Applicant, will necessitate a complete review of the <br /> Special Property Use Permit process in the City of Everett. <br />' 8. 4930 Elm Street will be the pre-school/day care facility. This <br /> structure shall be approved by the Building and Fire Departments prior <br /> to occupancy. <br /> `9• One sign with dimensions of 3' X 4' may be placed flat against the <br /> building on the '4930 structure. <br /> 10.
