titeron No.
That such variance is necessary for the preservation and enjoy-
ment of a substantial property right of the appellant possessed
by the owners of other properties in the same vicinity or zone.
a• F3D,diag Other corner lots in this vicinity and zone have
front yards oriented towards the length of the
lot instead cf the width (see Exhibit 4) , and in
the past the Board has granted variances in
similar situations.
b. Conclusion: Granting this variance will allow the Applicant a
property riqht possessed by others in this vicin-
ity and zone.
Criterion No 3•
That the authorization of such variance will not be materially
detrimental to the public welfare or injurious to property in the
vicfnity or zone in which the property is located.
a• F.1II$1a4.;_ The six foot setback on the south would abut the
side yard of the adjacent property and so would
provide a similar setback that is t}•pical for
other properties in that block.
b. Conclusion: It does not appear that grantinq this variance
would be detrimental to the public welfare or in-
jurious to other property in the vicinity and
zone since side yard typically abut and the six
foot setback would be similar to a typical side
yard setback.
C:iterion No. 4•
That the qranting of such variance will not adversely affect the
Comprehensive General Plan.
a. Findina: The General Plan designation for this site is
sinqle family detached and the setbacks as pro-
posed are typical of what is provided in this
desiqnation since there is a qreater than twenty
foot front and renr yard setback even though the
setback is oriented towards what the zoninq code
defines as side yards and the south setback which
is defined by code as rear yard really functions
as a side yard and is in keeping with the side
setback for this desiqnation.
b. Conclusion: Granting this variance will not adversely affect
the General Plan.
NOW, THEREFORE, the Hoard of Adjustment of the City of Everett
does hereby order that the variance be GRaNTED to allow a six foot
rear yard inRtead of the twenty foot rear yard required by code
and further require the applicant t.o meet the following condition.
1. Tha Applicant shall obtain all necessary building permits.
-Z-
