Criter�on No. <br /> That such variance is necessary for the preservation and enjoy- <br /> ment of a substantial property right of the appellant possessed <br /> by the owners of other properties in the same vicinity or zone. <br /> a. Findina: other corner lots in this vicinity and zone have <br /> front yards oriented towards the length of the <br /> lot instead of the width (see Exhibit 4) , and in <br /> the past the Board has granted variances in <br /> similar situations. <br /> b. Conclusion: Granting this variance will allow the Applicant a <br /> property right possessed by others in this vicin- <br /> ity and zone. <br /> Criterion No. 3: <br /> That the authorization of such variance will not be materially <br /> detrimental to the public welfare or injurious to property in the <br /> vicinity or zone in which the property is located. <br /> a. rindina: The six foot setback on the south would abut the <br /> side yard of the adjacent property and so would <br /> provide a similar setback that is typical for <br /> other properties in that block. <br /> b. Conclusion: It does not app�ar that qrantinq this variance <br /> would be detrimental to the public welfare or in- <br /> jurious to other property in the vicinity and <br /> zone since side yard typically abut and the six <br /> foot setback would be similar to a typical side <br /> yard setback. <br /> Crfterion No. 4- <br /> That the grantinq of such variance will not adversely affect the <br /> Comprehensive General Plan. <br /> a. Findina: The General Plan desiqnation for this site is <br /> single family detached and the setbacks as pro- <br /> posed are typical of what is provided in this <br /> designation since there is a greater than twenty <br /> foot front and rear yard satback even thouqh the <br /> setback is oriented towards what the zoninq code <br /> defines as side yards and the south setback which <br /> is defined by code as rear yard really functions <br /> as a side yard and is in keeping with the side <br /> setback for this designation. <br /> b. Conclusion: Granting this variance will not adversely affect <br /> the General Plan. <br /> NOW, THEREFORE, the Board of Adjustment of the City of Everett <br /> does hereby order that the variance be GRaNTED to allow ii six foot <br /> rear yard instead of the twenty foot rear yard required by code <br /> and further require the applicant to meet the following condition. <br /> 1. The Applicant shall obtain all necessary building permits. <br /> -2- <br />
