The applicant must record a covenant that runs with the land which waiws daims <br /> against the City, its officers, empbyees and agents, and indemnifles (induding <br /> reasonable attomey's fees), defends and saves the City, its officers, employees <br /> and agents harmless irom any loss or damage to people or property either on or <br /> off the subject property resulting from any fortn of soil movement whatsoever <br /> and/or from any fomi of failure in design and/or construcUon of the improvements <br /> thereon whatsoever.
