<br /> This agreemc:nt, made th.is day of . 19�� �
<br /> between DARL P. 'ciANLAN, a single man, herei.nafter called "Hanlan, "
<br /> and MAa�L M. SALES, a wido�v, hereinafter called �'Sales , " and
<br /> DSADGE JACOBSON, a single woman, hereinafter referred to as
<br /> "Jacobson, "
<br /> �VITNESSETH:
<br /> {9HEREAS, Jacobson desires to obL-ain the permission of Hanlan
<br /> and Sales to construct, place and bury a water line to be placed
<br /> on the property line between and separating Hanlan' s property
<br /> described as Slock 10 , Lo.t 2 , of Queen Anne A.ddition to Everett; .
<br /> and Sales property described as a portion of the SouCheast quarter
<br /> of the Northeast quarter o£ the Southeast quarter of Section 25 ,
<br /> Township 29 , Range 9 �ast, �9.h1. , which property lire is approximately
<br /> 185 feet, more or less, in length , in order to transport and
<br /> convey water from the City of Everett water line located on or
<br /> near Holbrook Avenue to a dwelling house to be constructed Uy
<br /> Jacobson on a portion of Lots 18 through 23 , inclusive, of IIlock
<br /> 10 of Queen Anne Addition to Everett, and Hanlan and Sales are
<br /> willinq to permit the use of their property at the above location
<br /> for the purposes above described, but only on the conditions
<br /> hereinafter set forth:
<br /> NOW THEREFORE, in consideration of the sum of $
<br /> which is in hand paid to Hanlan and Sales by Jacobson and in
<br /> consideration of the mutual dependent promises hereinafter
<br /> stated, the parties agree as follows :
<br /> 1. TERhSS 7L' PEFL'�1IT.
<br /> Hanlan and Sales will permit JacoUson to use their above
<br /> described property at their property line descriUed above for
<br /> the purpose of constructing , placing, burying, maintaininq and
<br /> repairing a water line to run from the City of Everett' s connection
<br /> on FIolbrook Avenue over and above the aUove described property
<br /> to a d�aelling house to be constructed on Lots 18 through 2�3',
<br /> inclusive, IIlock 10 , Queen �nne Additi.on, for the purpose of
<br /> transmitting and cor.ductinq �aater from the City of Everett wai:er
<br /> line to said dwellinq house.
<br /> Jacobson shall have no right to go upon the property of Hanlan
<br /> or Sales for any purpose other than to maintain and repair the
<br /> �vater line , and only �vi.th specific permission of Hanlan and Sales .
<br /> This license is revocable .at wil�y eithe= Eianlan and/or
<br /> Sales an or ei assigns , ezecu�ore and heirs , and/or until
<br /> such time as a public water line is available on rngland Avenue ,
<br /> City of �verett, which avenue abuts Jacobson' s property as
<br /> described herein.
<br /> Additionally, the above license shall be applicaUle and
<br /> is granted only so long as one single family dwelling to be,
<br /> constructed by Jacobson on the portion of Lots 18 through 23 ,
<br /> inclusive, Block 10 , Queen Anne Addition to �verett, is usin��
<br /> the �vater transmitted through said water line.
<br /> 2. RELEASE FRQM LIABILITY.
<br /> Jacobson hereby releases and discharges Uoth :'��l:iti and
<br /> Sa].es from any and all liability from damage which miync c�u.,,.�
