Building of which approximately 27,500 sq.ft. is useable floor space with the remaining <br /> areas being attic and other storage space azeas. <br /> The applicant is remodeling the first and second floor azeas of the subject building. The remodel is to <br /> improve the existing gambling and gaming areas that exist on these two floors. <br /> The subject property is located in the B-3 zone. 'fhe B-3 zone allows for mini casino gambling facilities, <br /> however restricts these uses to buildings that aze less than 8,000 sq.ft. in area. This zoning restriction <br /> became effective August 4, 1999. <br /> The applicant has provided documentation that the gambling and gaming activities existed in the <br /> building prior to the 8,000 sq.ft. building rest:iction being adopted. <br /> A license to operate a cardroom�vas issued to the site in June of 1996. A license to operate amusement <br /> games and a separate pulltab license was issued in Mazch of 1997. <br /> Decision: I hereby certify that gambling and gaming uses existed in the subject building as described <br /> above and are therefore deemed non-conforming. These uses were limited to the first and second floors <br /> only of the subject building and were established prior to the August 4, 1999 zoning code restriction that <br /> limits these uses to buildings that are less than 8,000 sq.ft, in azea. Anv future chaoee of this use,or <br /> anv future exaansion of this use into anv other areas of the buildio¢ must be review and aooroved <br /> bv the Citv.
