This easement is g[a�ited subject to and conditioned upon the following <br /> tecros, conditions and covenants: <br /> 1. The Gcantor shall at all times conduct its activities and all <br /> othec activities conducted on Grantor's property so as not to intecfere <br /> with, obsttuct oc endanqec the useEulness of any improvements, or other <br /> facilities, now or hereaftec maintained upon the easement, oc in any way <br /> intecfece with, obstcuct or endangec the City's use of the easement. <br /> 2. Pcior to any construction, work or any other activity by the <br /> Grantor on the easement, a notification and plans fo� the same shall be <br /> submitted in writing to the City by the Grantoc and no such constcur,tion, <br /> work or activity by the Grantor shall be commenced without the City's prioc <br /> wcitten approval; pROVIDED, H9WEVER, Any changes oc revisions in the plans <br /> shall also be subject to the City's prior appcoval. The City's review of <br /> the Grantoc 's plans under this easement shall not be deemed to impose any <br /> duty oc obligation on the City to d�termine the adequacy or sufficiency oE <br /> the Gcantoe 's plans and designs nor whether the Granlor 's construction, wock <br /> or activity is in conformance with othec applicable plans, codes and <br /> � <br /> cegulations. Fucther, approval by the City to such construction, wock or <br /> activity shall not in any manner be considered as imposing any obligation, <br /> duty oc liability upon the City as to the safety oe propriety of such <br /> construction, wo[k or activity. <br /> 3. The Grantoe hereby authurizes the City to cut, tcim and remove <br /> any and all b[ush, trees, other vegetation or debcis upon the easement and <br /> the right of access for such purpoces, Grantoc also authoci2es the City to <br /> cut, trim and cemove any and all brush, trees, other vegetation and debris <br /> on Gcanto[ 's property which, in the City's reasonable judgment, censtitutes <br /> a hazard L•o the easement and the [;ght of access fuc such purposes. <br /> 4 .
