Before any permits are issued, either a vacation cr lease agreement mu�t be <br /> obtained for use of the City right-of-way per Ordinance 1048-84 (SEPA <br /> Transpor[ation/Circulztion Pol3cies). <br /> 9. A minimum five-foot wide planting strip mus[ be provided along the entire <br /> Everett Mall Way froatage, except for driveways, in conpliance with Section <br /> 19.40.050 of the Zoning Code and Section 1.13 of t��e Standards and <br /> Specifications Manual (SEPA Aesthetics and Light and Glare Policies). <br /> The lead agency for this proposal has determined thst it does not have a probable <br /> significant adverse impact an the environment. An Environmental Impact Statemen[ <br /> is not required under RCW 43.21C.030(2)(c). This determination assumes compliance <br /> vith state law and C3ty ordinances related to general environmental pro[ection <br /> including but not limited to righ[-of-way improvement requirements, drainage, <br /> etc. This decision uas made after review of a r_ompleted environmental checklis[ <br /> and other information on file with the lead agen�y. This information is available <br /> to the public on request. Thi.s Determination uf Non-Significance is specifically <br /> conditioned on compliance with the conditions attached hereto which are <br /> incorporated by reference as if fully set forth herein. <br />
