Box 532� <br /> Everett, WA 98206 <br /> RE: Address 1007 Everett Mall Way - Arby's _ <br /> Dear Mr. Baldwin: <br /> Please be advised that the City of Everett Planning and Building Departments <br /> are hereby informing you that the activity on the above property is in <br /> violation of the City of Everett's Zoning Ordinance� specifically with <br /> reference to Everett Municipal Code �E.M.C) Chapter 14.42 19.40, and the <br /> City�s Standards and Specifications Manual (copies enclosed). These are also <br /> violations of the Determinatioa of Non-Significance (l17-85) issued for the <br /> proposal. (copy enclosed) <br /> Description of Violation: Parking has not been provided per zoning code <br /> requirements. 70 spaces were required for the 4,000 sf building. An <br /> additional 3 spaces are r•eyuii�ed for the storage expansion. Only 65 spaces <br /> are proviCed on site. A landscape screen has not been provided on the north <br /> property boundary. Landscaping on the frontage does not meet City standards. <br /> Thp following corrective measures must be taken: Parking must be provided to <br /> code or a variance must be obtained from the Hoard of Adjustment. <br /> Sight-obscuring landscaping must be provide9 on the north property line. <br /> Landscaping of the frontage mUst be upgraAed to City standards. Please note <br /> that the City has received numerous complaints from neighbors to the north <br /> regarding the lack of landscaping on the property line. <br /> Please notify Mary Cunningham of this office at 259-8731 or Planning <br /> Department, 3002 Wetmore, Everett, WA 98201 when the violation has been <br /> corrected. If we do not hear from you by March 11. 1986 the City will begin <br /> enforcement action. See enclosed copy of E.M.C.
