I also briefl� discussed this situation with Larry Crawford as there appeared to be some <br />engineering considerations involved per Steve r4iller's attached letter of October 11, 1990, to Gary Connor. <br />As we discussed, c,ur concern is having to potentially sprinkler a portion of an existing non-sprinklered <br />building to be occupied by The Olive Garden. The UBC can appazently be interpreted to class:'ry this family- <br />oriented restaurant as a"drinking establishment" and require spnnklers when the si�e exceeds 5,000 squaze <br />fee[. Where I grew up, a"drinking establishment" was a bar or tavern ttat specialized in beverages, not <br />food. The explanation given in Section 3802(c)1. references additional protection being needed based on an <br />occupant's diminished reactions due to alcohol consumption. This is an the context of a"d.rinking <br />establishment". Apparentiy the Code has not defined "dnnking establishment' so there must �� some <br />reasonable discretion available to the governmental ofYicials. Enc!osed is a copy of a page from We6ster's 11 <br />New Riverside Universiry Dictionary defining the word "bar", as the phrase "dnnking establishment" is not <br />defined. It does not sound like 1'he Olive Garden restaurant. By intent, ctesign, function and opentional <br />philosophy, The Olive Garden restaurant is dramatically different from a tavern or lounge where a high <br />percentage of revenues come from alcoholic beverages, and such b..verag�s are ofren highly promoted. <br />Current plans show less than 15% of the tota] seating in the restaurant is in the bsr azea. Rather than being <br />hidden or tucked off back .n a corner, it is conveniently located adjacent to the hostess station an3 really <br />funetions as an overflow wa.it�ng area. <br />I appreciate your wiliingness to look inro this ro see if there are some suggestions as to how we might <br />proceed. Both the restaurant division o,` General Mills and we are most anxious to have this resolved so that <br />a permit can be issued and construction can commence. If it would be helpful we would be available almost <br />immediately to meet at the Building Department to further review this situation.
