I just spoke with our land use attorney, Tnom Graafstra, and he -an 100% confirm that the intent of
the June 12, 2001 Declaration of Easernent was to establish a formal drainage easement from the mall
property to the Titanic six acre parcel. Thom worked on this document in 2001, representing Tit.nic
Associates, so he can confirm the intent of all parties.
L.
General Manager, Everett Mall
Steadfast Commercial Management Co., Inc.
1402 S.E. This is
the drainage easement across the lwo parcels south of the Mall. I believe that this document is adequate
to cover the existing storm drain pipe that the City of Everett has expressed concern about. Please fcllow
up with your land use attorney. I will (ollow up with Paul McKee. Thanks.
Darren A. Simpson
DCI Engineers Inc.
425 827 2238
n a!on.
