Cc: ?atrick Cor;
Subject: RE: Existiny Inter Urban Trail nasericnt
1 would recommend using Tom Grafstra (i25) 259-9149
!thomy@snoomishlaw.com) who i.s in Washingion and has wurked o. the mall for 1ear=. :;e is
:ery familiar with all legzl easements and entitlemenLs for the property.
Patrick and I are in agreement that since the original easement was bi-lateral,
iudemr, ifying each othe-, we should get the same pricilege.
Let's get a final draft to Mike and get on the 9/21 committee meeting.
By the way, the trail we are talking about will be open to the public in a fem.aeeks, so
there shouldn't be any public outcry.
;:c did not buy the easement. Patrick has information regarding the transaction between u
a;:d the PUD. F'rom what I understand, we bought encroachment rights upon their propercy co
do improvements to the land,
(ie: our parking field between SEARS and village :enter). Since construction began, ;r_
ha_ had to re-routc tne trail .nd sotnetmrs close the trai Lr a day hnre or. there.
Thanks,
.?a:nes Palda
Froject I,anager
Stead£ast Properties & DevelopmenC
20911 S.W. He told me that tne whole issue of th casement o-ras
orought to the City's attention by a user of the trail. They had closed part of it down
and caught grief from the users re usa of federal funds, etc. His concern is that if tha
sa::ement goes to council, some of these 'wildcards' may show up and real.ly slow the
proces:r down. He indicated the City was fine granting indemrification to other public
agencies, but private parties always had to go through the process. I told him Steadfast
had every intention of granting the easement, but we really did need to send it through
coimcil .
1!c has put us on the calendar for the Real Estate Committee's next meeting, which is
:.-;eptember 21. Once the committee approves the easement, it goes to council and thc publi,:
aets to comment.
: also told him I had some concerns about Paragraph 2(c) of the current easement re
_ndustrial Insurance and that i would need to have the easement reviewed by oar 47ashinato❑
counsel, as I was unfamiliar with the law in 47ashington. I said I would try to get
avised draft of the easement to him by the end of next week so he had something cleen o
cz;Fce tu committee.
Yic also spoke re extinguishing the current easement. He was under the impression that
.,..ad£ast had bouqht the fee inCrest .in the currenc PUD easemeet and that uie could add
l.nqur_e to our ur.=,Pt tc a::ti.guis-h to cur_enC easetncnc. tIc tondcred ahy iae hadn'c said
A
