' <br />r <br />� <br />r <br />t <br />s <br />k <br />tp� <br />p <br />x <br />the Shoppinq Center or contiguous property, (ii) repairs o� <br />alterationa in or to the Common Areas or to any utility type <br />facilities, (iii) preventinq the public from obtaininq pre:s- <br />criptiv� riqhta in or to the Common 1lreas, (iv) emerqency or <br />security reasons, or (v) doing and performinq such other acts <br />as in the use of qood business judqment Landlord shall deter- <br />mine to be appropriate for the Shoppinq Center; provided <br />however, that Landlord shall uae reasonable efforts not to <br />unduly interfere with or disrupt Tenant's business. <br />CONSTRUCT7.ON OF PREMISES <br />Section 8. (a) Prior to the Commencement Date, Landlord shall <br />complete the improvements to the Premises subetantially as <br />described in Exhibit "C" attached hereto and made a part <br />hereof by reference. Tenant hereby approves Exhibit "C" and <br />all of the improvements, plans and apecifications described <br />therein. It is understoed and agreed by Tenant that chanqes in <br />such improvements, plans and specifications which will not <br />materially interfere with Tenant's use of the Premises and <br />which may be necessary durinq construction of the Premises <br />shall not affect, invalidate, or chanqe this Lease or any of <br />its terms and provisions. . <br />(b) Landlord's work in accordance with Exhibit "C" <br />shall be deemed approved by Tenant in all respects thirty (30) <br />days after the Commencement Date, unless prior thereto Landlord <br />receives written notics from Tenant of any defect in such work. <br />Any disaqreement which may arise between-Landlord__and Tenant <br />concerninq the work to be performed by Landlord sfiall be <br />resolved by the decisions of Landlord's architect. � <br />� (c) Tenant shall complete the improvements to the <br />Premises described in Exhibit "D" � attached hereto and made a <br />part hereof by reference. Landlord and Ter.ant hezeby approve <br />Exhibit "D" and all of the improvements, p;ans and specifica- <br />tions described therein, provided that Tenant's work described <br />in Exhibit "D" shall be performed in accordance with the <br />provisions of Section 12(a)(i) hereof; and provided further <br />that any change in the improvements, plans and specifications <br />described in Exhibit "D" shall be approved by '.Landlord in <br />writing in accordance with the provisions of Section 12(a)(ii) <br />hereof. <br />USE � <br />— (the "Fixture Pe <br />Section 9. (a) The Premises shall be occupied and used exclus- <br />ively for the purposes described on th� Reference Paqe. No <br />amusement gar.:es of ar.y cha:acter or description may be used or <br />offered for use in the Premises. No live entertainment shall <br />be provided in the Premises unless express].y permitted herein. <br />Tenant shall commence business in the Premises on or before 30 <br />days after the Cortunencement Date n shall operate one hundred <br />percent (1008) of the Premises durinq the entire Term, and <br />shall keep the Premises fully stocked with merchandise and <br />staffed with personnel so as to maximize Gross Sales at the <br />Premises at all times. Tenant shall conduct ita business in <br />the Premises on a11 business days durinq all hours as from time <br />to time may be reasonzbTy determined by Landlord to be consis- <br />tent wi.r.h the fIAYp a�:? hour� of other tenants in the Snoppii�q <br />Center, but in no event less than eiqht (8) hours in a business <br />day, six (6) days a week and sixty (60) hours a week. Tenant <br />may close the Premises durinq reasonable periods for repairinq, <br />cleaninq or decoratinq the Premises, with the prior written <br />consent of Landlord. in the event the Premises are located in <br />a newly constructed, enclosed or remodeled portion of the <br />Shopping Center, Tenant aqrees to cooperate to effect a joint <br />openinq of such portion of the Shoppinq Center, and, if so <br />requested by Landlord, aqrees to delay the �peninq of Tenant's <br />-B- <br />
