Novembcr 2, 2012
Mr. Tony Lec
Building Official
City of Everen
3200 Cedar St.
Everett, WA 98201
RG: 716 SE Evcrett Mall Way

JANKELSON LACEY PARTNERSHIP
PO Box 98210
Lahcvood, Washington 93496
(253) 405-0228
far (253) 89-0486
Debra Bryant
ChicfAdministrativc Oflicc
City of Everett
2930 Wetmore Avcnuc
Everctt, WA 9820I
Dcar Tony and Debra,
This Ictter is to summarize my understanding of the steps fonvard which wcre mutually agecd as the means for
resolving Ihe issues on this buitding. In the mccting yesterday I expressed to Debra and yourself that 1 appreciated
the attention you have given this since I contacted you about the initial srop work order and unlawPul structure tag
that was posted on the building. You havc bcen very responsive in sorting out thc facts and history and getting down
to the few remaining issues, which are quite dilTerent than those originally posed. f do not agrcc with the
characterization that work has been done in the building without a pertnit. To the contrary, I think the history shows
that wc, as owners, who acquired the building in 2001, have becn extrcmely awarc ofdoing work only with permits,
both is 2001 and 2008. As well as for the remodel/expansion on the Grocery Outlet [3uilding, this is part of our
ownership of this parcel. I understand, as you do, that reconswcting hisrory that now dates back more than a decade
is difficult and ihat Ciry records may not be complete regarding cenain work elements. Regardless of our difiercnt
positions regarding the staWs of past permits, and ihe work done pursuant to lhem, I agree that it is time to movc
forward and deal with the acwal few conditions in the building that are your concem. My understandings of these
stcps are as follows:
1. We will arrenge to have a structural engineer review the "live load" capacity of the 5000 +/-
square feet upper level, to determine if it meets the requirement to designate this area for
"storage." So there is no misunderstanding, please send me the floor plan with the
approximately 1000 square feet clearly designated. Secondly, we will have the structural
engineer review the shear wall requirement on the lower level.
2. You will advise us of the maximum occupancy capacity of the upper level that would require
only one set of stairs so that one set of stairs could be blocked off from use.
3. The shower on the upper Ievel will be removed and plumbing for the shower will be "capped
ofY'.
i. If oniy one set of stairs will be required (item 2 above) we will "block" the larger set of stairs
from use and make the necessary adjustments to the remaining stairs to meet code.
5. We will install "exit signs" in locations as directed (hard vired with battery packs).
6. I believe that all exit doors presently have an "outward swing" but we will be sure that this is the
case.
Please let me know if 1 have covercd all itcros llat rcquire our attcntion, or if I have misunderstood any of thc abovc.
M3
