I unders�and you and Kathy have been in communication with regard to certain <br />questions pertaining to wcUands. I have workcd with Kathy extensively on this, and based upon <br />my discussions with her, I am writing to make a proposal to resolve thc issucs that have arisen <br />with respect to the property. It is my intention in drafting this proposal and sending it to you that <br />it be treated as a setticmcnt offcr, and as such it would be inadmissible in the event, heaven forbid, <br />that litigation should ensue. I also wish to make it perfectly clear that the proposal is not in any <br />way an admission by the partnership that any wetland ever existed on our property or that the <br />Ilooding of that property was caused by anything other than rortious actions by third parties over <br />whom the owners of the property had no control. <br />Ail that being said, I have been authorized by my partners to offer to permanenUy <br />designate the southeasterly 40 feet of thc above-referenced property as a natural area, in retum <br />for certain considerations which will be discussed shortly. Specifically, the 40-foot by 40-foot <br />section which is shown on the attached tas plat map (not to scale) would be subject to a perpetual <br />environmental easement or something conceptually similar. As additional consideration, the <br />Liebman-Kao Partnership will release the City of Everett from any claims it may have against the <br />city for the very suUstantial expense and delay caused by the artificial flooding of our property. <br />\ <br />�j � <br />
