Federal law requires cities to authorize OVS operators to operate in the cities. While an <br /> OVS operator can operate as a video cable operator like the current local cable operator, Comcast, <br /> Black Rock has a different business model. Black Rock provides fiber optic capacity to business users. <br /> The franchise provides that Black Rock will pay a franchise fee of 5% of gross revenues. If, as, and <br /> when Black Rock provides video cable services like Comcast, Black Rock will provide government and <br /> educational access channels. The franchise does not allow Black Rock to provide telecommunication <br /> services. If Black Rock offers telecommunication services, it will need either a separate franchise from <br /> the City or an amendment to this franchise. As with other franchises, Black Rock must obtain specific <br /> construction and right of way permits from the City for the specific locations of its facilities. <br /> Council previously granted a franchise to Black Rock in 2000,which franchise expired after two years. <br /> The purpose of the short duration of the franchise was to allow the City time to complete negotiations <br /> with AT&T Broadband for the video cable franchise. The AT&T Broadband (now Comcast) video <br /> cable franchise is the basis of the proposed franchise with Black Rock. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Adopt an Ordinance Granting an Open Video Service Franchise to Black Rock Cable, Inc. <br />
