City Council and the Department of Ecology approved an updated SMP in 2002. The SMP <br /> was subsequently appealed to the Central Puget Sound Growth Hearings Board and Court of Appeals. The <br /> settlement agreement between the City of Everett, Port of Everett, Washington Environmental Council, <br /> Everett Shorelines Coalition, and Department of Ecology requires the subject amendments to the SMP. <br /> The amendments include a new Shoreline Restoration Element; an Interim Agriculture Conservancy <br /> designation for the Marshlands until a subarea plan is completed;more conservative default buffers for the <br /> highest rated wetlands,primarily on Smith and North Spencer Islands; amendments to standards for <br /> stormwater facilities in buffers; and modifications to mitigation requirements. <br /> The proposal also includes adoption of the amendments to meet Growth Management Act requirements for <br /> critical areas in shoreline jurisdiction. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Approve the Ordinance amending the Shoreline Master Program, Comprehensive Plan, and Zoning Code to <br /> implement an appeal Settlement Agreement and to meet GMA requirements for critical areas in shoreline <br /> jurisdiction. <br /> 5 6� <br />
