A Resolution Approving a rezone of Property Located at 2316 12th Street, from R-3 to R-3 PRD (Multiple Family—Planned Residential Development) and a Preliminary Subdivision of Twenty (20) lots. WHEREAS, 12th Street Partners filed an application to rezone property generally located at 2316 12th Street from R-3 (Multiple Family Medium Density Residential)to R-3 Planned Residential Development(R-3 PRD) and concurrently filed an application to subdivide said property into twenty(20) single family lots for the purpose of re-locating eleven (11) homes from the Historic Donovan District and provide nine (9) other lots for construction of new single family detached dwellings; and WHEREAS, The Hearing Examiner of the City of Everett held a public hearing and did adopt findings, conclusions, and a decision dated August 11, 2005, recommending to the Everett City Council that the proposed preliminary Subdivision be approved in accordance with the conditions of the Examiners Decision and that the proposed Planned Residential Development (rezone)be approved pursuant to the provisions of Chapter 32 and Section 41.160 D of EMC Title 19 (Zoning Code), as amended, subject to the conditions; and WHEREAS; The City Council Finds: 1. The Planned Residential Development(rezone) is consistent with the Everett General Plan; and 2. The Planned Residential Development(rezone)bears a substantial relation to the public health, safety and welfare and promotes the best long term interest of the Everett community; and 3. The terms of this Resolution are sufficient to mitigate adverse impacts upon existing or anticipated land uses in the immediate vicinity of the property herein described in Exhibit "B".
