Further, the City reserves the right to modify, condition or enforce this Agreement in the event <br /> that the site plan is not developed in accordance with the Schedule or the provisions of this <br /> Agreement are not met. <br /> The County will present as detailed a design as possible at each stage of the approval process and <br /> will correlate the information of one design element to all future elements. <br /> The City will have the opportunity to review and approve final designs against the standards <br /> established through the PDO approval process. <br /> 4. 2 MODIFICATIONS: <br /> Upon approval of this Agreement, minor modifications to the Site Plan and Mitigation Conditions <br /> as defined in EMC 19.41.160D(9) may be addressed administratively by the Director of Planning <br /> and Community Development after consultation with affected departments and agencies. <br /> Major modifications to the site plan and Mitigation Conditions as defined in EMC <br /> 19.41.160D(10)will require a recommendation of the Everett Planning Commission and approval <br /> by the Everett City Council. <br /> Changes to provisions of this Agreement approved by the City shall supercede the particular <br /> provision as originally written. Every effort will be taken to update this written agreement <br /> through formal amendments or Addenda, but the approved change will control. <br /> 4.3 SEPA: <br /> In approving this Agreement, the City acknowledges that it has undertaken and completed all <br /> currently required environmental review for the County project. Further environmental review <br /> shall not be required for individual permits consistent with the approved Project (e.g., building <br /> permits, public works permits, site plan) provided that every such permit shall be conditioned in <br /> accordance with the terms and conditions of this Agreement. <br /> As the project produces additional detail, additional SEPA analysis may be required if the project <br /> is modified such that additional impacts are likely. Those impacts will be presented as addenda <br /> to the Supplemental Environmental Impact Statement (SEIS) (August, 2002) unless there are <br /> substantial changes to the proposal likely to have significant adverse environmental impacts or <br /> there is significant new information indicating probable significant adverse impacts, in <br /> accordance with WAC 197-11-405(4). <br /> In those cases, a revised SEIS will be prepared and circulated for public comment. <br /> 4.4 ZONING FOR SITE: <br /> The area described in the legal description and shown on Attachment A shall be zoned B-3 and if <br /> there is confusion on standards the standards in the B-3 zone apply. <br /> PART FIVE—GENERAL TERMS <br /> 5.1 DURATION: <br /> Development Agreement Page 11 Snohomish County <br /> Campus Redevelopment Initiative <br />
