1. The variance is necessary because of exceptional or extraordinary <br /> circumstances regarding the size, shape, topography, or location of the subject <br /> property; or the location of a pre-existing improvement on the subject property <br /> that conformed to the zoning code in effect when the improvement was <br /> constructed. <br /> 2. The variance will not be materially detrimental to the property in the area of the <br /> subject property or to the City as a whole. <br /> 3. The variance will only grant the subject property the same general rights <br /> enjoyed by other properties in the same area and zone as the subject property. <br /> 4. The variance is the minimum necessary to allow the subject property the <br /> general rights described in Criterion 3. <br /> 5. The granting of the variance is consistent with the goals and policies of the <br /> Everett General Plan. <br /> 6. The need for the requested variance is not the result of a self-created hardship. <br /> 11. Approximately 30 feet of fill have been placed on-site during the construction of SR <br /> 526 and Casino Road. Removal of the fill could result in substantial erosion which <br /> would impact nearby Merrill and Ring Creek and the wetland on-site. These are <br /> special circumstances relating to the topography that necessitate the grant of the <br /> variance. (exhibit 1) <br /> 12. The height variance will not be detrimental to adjacent residential properties. The <br /> topographic elevation of the adjacent residential properties is higher than the existing <br /> topography on-site. With the setbacks of the multiple-family buildings constructed on- <br /> site, the appearance will not impact other properties. (exhibit 1, Palacios testimony) <br /> 13. The variance will allow the construction of three-story structures permitted in the R-3 <br /> zone. (exhibit 1) <br /> 14. Removal of the fill could cause environmental impacts and make access to the site <br /> difficult. The variance is the minimum necessary to allow the subject property general <br /> rights granted to properties in the general vicinity. (exhibit 1) <br /> 15. The Everett General Comprehensive Plan designates the subject property as 1.6, <br /> Multiple-Family, 20-29 Dwellings per Gross Acre. While the density is less than half <br /> the maximum allowed density, the location of the subject property limits the density. <br /> The grant of the variance is consistent with the goals and policies of the Everett <br /> General Comprehensive Plan. (exhibit 1) <br /> 16. The grant of the variance is not the result of a self-created hardship. The variance <br /> became necessary as the result of fill placed on-site during the construction of <br /> highways in the area prior to the Applicant's ownership of the subject property. <br /> (exhibit 1) <br /> 4 <br />
