EASEMENT <br /> immunity under Industrial Insurance,Title 51, RCW, and acknowledges that this waiver has been <br /> mutually negotiated by the parties. <br /> 8. The Grantor also covenants to the City that Grantor is lawfully seized and <br /> possessed of the land aforesaid; has a good and lawful right and power to sell and convey same; <br /> and that Grantor will warrant and defend the title to said easement and the quiet possession <br /> thereof against the lawful claims and demands of all persons whomsoever, so long as Grantor <br /> remains legal owner of the Property on which easement is granted <br /> [PsCI] 9. This easement may be terminated for cause by Grantor upon 180 days notice in <br /> writing to City where cause shall be the City's abandonment or termination of use of the facilities <br /> as a recreational trail. Cause shall exist also if City violates any substantive portion or <br /> requirement of this easement and the violation is not remedied within 90 day after City receives <br /> written notice of the violation from Grantor, or if the violation is not subject to reasonable <br /> remedy. <br /> 10. The rights and obligations of the Grantor shall inure to the benefit of and be binding <br /> upon its respective heirs, successors and assigns.
