I <br />LICENSE FOR USE OF CITY PROPERTY <br />I. Definitions <br />A. "City" means the City of Everett, a municipal corporation organized under the <br />laws of the State of Washingto,i. <br />B. City Property" means <br />Block 2, J.S. Sines Acre Tracts, according to the plat thereof recorded in Volume <br />4 of Plats, page 11, records of Snohomish County, Washington; <br />Together with the vacated alley lying between the East half and the West half of <br />said Block 2; <br />EXCEPT that portion thereof deeded to the City of Everett by deed recorded <br />under recording number 7712300213 <br />C. "Atkinson" means Atkinson-CH2MHill, a Joint Venture, 2802 Wetmore Ste. 500, <br />Everett, WA. 98201. <br />D. "I-5 HOV Project" means a construction project by the Washington State <br />Department of Transportation known as 1-5 - Everett, SR 526 to US 2 HOV Lanes, a <br />design/build project. <br />II. Background <br />A. Atkinson desires to use City Property for its work on the I-5 HOV Project. <br />B. The City is willing to grant Atkinson a license to use City Property for such <br />purpose on certain terms and conditions. <br />III. License <br />A. The City grants Atkinson license and permission to use City Property for the <br />purpose described in section II(A), subject to the terms and conditions of this License. <br />B. The initial term of this License is thirty (30) months, commencing October 1, <br />2005. After the initial term, this License shall be in effect from month to month and may <br />be terminated by either City or Atkinson on sixty days' written notice. <br />C. This License is: (1) personal to Atkinson; (2) may not be assigned, pledged, <br />hypothecated, encumbered, or transferred; and (3) does not run with, or attach to, City <br />Property. <br />14 <br />
