KLB has requested the use of the City of <br />Everett's property located North of 36`h St. and West of the Snohomish River (Eclipse Mill parcels 3, 4, & 5) <br />for importing and exporting fill material for the I-5 HOV Project. KLB will have exclusive use of the <br />property for a 24 months period. In exchange for the use of the City's property KLB is require to complete <br />the following tasks : <br />I . On Parcel 3, leave in place for City's use 75,000 cubic yards of fill material within 15 months of the <br />City acquiring permits for permanently placing Fill Material on the site. <br />2. On parcels 4 & 5, leave in place for City's use 150,000 cubic yards of fill material on or before <br />October 1, 2007. <br />3. At the completion of the License spread the fill material evenly over adjoining City owned property <br />within 400 feet of parcels 3, 4, & 5, within 90 days. <br />4. Install temporary silt fencing and perimeter security fencing with lockable gates. <br />5. Maintain property & entrance roads, and'sweep adjacent streets. <br />The additional fill material on the property will raise it above the 100 year flood level which is needed for <br />future development. <br />RECOMMENDATION (Exact action requested of Council): <br />Authorize the Mayor to execute the License Agreement with KLB, Construction, Inc. to use city of Everett <br />property located at north of 36"' St. on Eclipse Mill Road for importing and exporting fill material for the I-5 <br />HOV Project 5 <br />
