8 <br /> ,Section 2: Ordinance No. 1594-89 (Chapter 2.74 EMC) is hereby amended by <br /> the addition of the following section which shall be codified in a new section EMC <br /> 2.74.045 under"I.Appointive Officers". <br /> Sick Leave Incentive Plan <br /> Appointive Officers who have successfully passed probation shall be allowed, upon <br /> voluntary separation, retirement or in situations of reduction in force from City <br /> employment, to receive a payment equal to ten percent (10%) of the value of their then <br /> existing sick leave accrual balances. <br /> Section 3: Non-application to Deputy Fire Chiefs and Fire Marshal <br /> Due to the pendency of a PERC representation case(Case No. 18827-E-04-2985) and <br /> pursuant to WAC 391-25-140 (2), this Ordinance shall have no application to the <br /> appointive officer positions of deputy fire chief and fire marshal, except in the event and <br /> to the extent an incumbent in those positions is ultimately found to be not represented for <br /> purposes of Chapter 41.56 RCW. <br /> Section 4: Severability <br /> The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City <br /> Council that it would have passed all portions of this ordinance independent of the <br /> elimination herefrom of any such portion as may be declared invalid. <br /> Section 5: Corrections <br /> The City Clerk and the codifers of this Ordinance are authorized to make necessary <br /> corrections to the Ordinance including,but not limited to, the correction of scrivener's <br /> errors, references, ordinance numbering, section/subsection numbers and any references <br /> thereto. <br /> RAY STEPHANSON, Mayor <br /> ATTEST: <br /> SHARON L.
