12 Ya AMENDMENT NO.4 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF EVERETT AND PERTEET,INC. WHEREAS, Perteet, Inc. and the City entered into an agreement dated April 21, 2003 ("Agreement")to provide services in connection with the East Marine View Drive Project; and WHEREAS, the parties amended the agreement on December 5, 2003 to provide surveying, basemapping, design report and environmental documentation and to increase the total compensation; and WHEREAS, the parties again amended the agreement on May 17, 2004 to provide to provide an air and noise impact study and geotechnical analysis and to increase the total compensation; and WHEREAS, the parties again amended the agreement on December 27, 2004 to provide Phase III Final PS&E Design Services, to extend the time for completion to December 31, 2005, and to increase the total compensation; and WHEREAS, the parties now desire to amend the agreement to provide value engineering/constructability review, and sewer design services; and WHEREAS, the agreement as amended is likely to expire prior to completion of the services and the parties expect the work to be completed by March 31, 2006; and NOW THEREFORE, the City of Everett and Perteet, Inc. agree to amend and modify the previously amended Agreement as follows: A. Paragraph 1 of the Agreement is amended to read as follows: 1. Engagement of Contractor. Exhibit A — Scope of Work shall be amended to include the services detailed in Exhibit A-1 — Scope of Work, attached hereto and made a part of this Agreement. B. Paragraph 3 of the Agreement is amended to read as follows: 3. Time of Beginning and Completion of Performance. This Agreement shall commence as of the date of execution of this Agreement and shall be completed by March 31, 2006. C.
