City of Everett/Interfaith Association 2016 M&0 2060 Agreement claim or benefit for the Owner, its employees, consultants, Project contractors or subcontractors, which might arise under the Washington state industrial insurance laws that address workers' compensation. E. General Requirements Insurance shall be placed with insurance carriers licensed to do business in the State of Washington and with carriers subject to approval by the City. Insurance carriers providing insurance in accordance with this Agreement shall be acceptable to the City, and shall have an AM Best rating of A: VII or better. Prior to the execution of this Agreement, the Owner shall provide the City a certificate of insurance with additional insured endorsement as evidence of coverage and have City of Everett, its officers, elected officials, agents and employees named on its policy as an additional insured. Approval of insurance is a condition precedent to approval of this SHP Agreement by Risk Management. All insurance shall be placed with insurance carriers licensed to do business in Washington State and with carriers subject to approval by the City. The City maintains the right to receive a certified copy of all insurance policies. The Owner's insurance shall be endorsed to state that coverage shall not be cancelled by either party, except after thirty (30) days' prior written notice has been given to the City. The Owner shall include all subcontractors as insured's under its policies or shall furnish separate certificates and endorsements for each subcontractor. All coverage for subcontractors shall be subject to all of the same insurance requirements as stated herein for the Owner. The Owner's insurance coverage shall be primary insurance as respects the City. Any insurance, self-insurance, or insurance pool coverage maintained by the City shall be excess of the Owner's insurance and shall not contribute with it. VII. Reserved VIII. ENVIRONMENTAL REVIEW The Grantee retains responsibility for fulfilling the requirements of the State Environmental Policy Act (SEPA) and regulations and ordinances adopted thereunder. IX. Reserved X. REPORTING REQUIREMENTS; ANNUAL REPORTS Once the Project has been completed, the Grantee shall, for the term of the Agreement, submit to the City upon request tenant information, which may include, but is not limited to, income, household size, race, disability status, beds occupied, number of persons turned away, etc. 6
