A hearing was held ou t]ie application of Marcus Stein, 140 iVIagnolia, Everett, for a variance from Section 15. 04. 090 E. C. C. (Zon:ng Code) R-Z, Single Pamily Iligh Density Residence Zone, SuUsection E, yard requiremen[s for permission to construct a garage to the east property line. Airport Acres, Lot 4II, less East 40 ft. and all Lot 49 and less East 5 ft, of North 72 feet of West 20 feet, Lot 48 to City of Everett. 140 AiIagnolia ' �._-�-------- Mr. Craig I'ullerton of Che City of Everett Engineerin� Deparhnent spokc �n bchalf of Mr. Stein. I�e stated that Mr. 5tein had inentioned building a garage on t]ie east side of his house at the time the City purdiased a portion of Lot 4II from A4r. Stein. The Engineering Department volunteered to assist Mr. 5tein in attempting to acquire a variance from the Board of Adjustinent so he could build his garage to the East property line. rTlic Engineering Department felt they had created a l�ardsliip For Mr. Stein � when tliey purchased a portion of his property. There were no further comments from the audience. After visual observation of t:lie subject property and considering all the facCs, it was moved by Mr. Ingram, seconded Uy Mr. ]3aird, and unanimously carried to grant the applicant's request for the following reasons: 1. The granting of Yhc variance will not be det:rimental to lhe area as the adjacent property to the East is owned by the City. ?. Gr�nting tlie variance will assist the o�vner in the fiill enjoyinent of his property rights. 3. 'Cltc granting of the variance tivill not adversely affect tlie Comnrehensive Land Use Plan.
