i <br /> . <br /> �,'����F'�" <br /> � <br /> PLANNING DIRECTOR DETERMINATION ` <br /> Fence Modification <br /> Review Process I #04-022 <br /> INTRODUCTION: Th� City of Everett Planning Department has received an application <br /> from Balwant Singh, 1301 Lombard Avenue, Everett, WA, 98201, to place a six-foot tall <br /> chainlink fence within the front yard setback. Section 39.070.A.1 of the Everett Zoning <br /> Code grants the Planning Director the ability to permit a fence to exceed the maximum <br /> allowable height of forty-two inches within the front setback, through Rev��w Process ] <br /> as described in the City's Locai Project Review and Procedures Ordinance. <br /> BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the <br /> maximum height of fences located within the front yard setback shall not e;cceed forty- <br /> two inches in height unless approved by the Planning Director usinn the review process <br /> described in lhe City's Local Project Review and Procedures Ordinance. <br /> The subject propertV is located in the R-2 z^nc a^d ic de��e!cFed �viih a one-story motel <br /> buiiding. The City of Everett Board of Adjustment approved a variance for construction <br /> of said .��;;;�I on April 9, 1957. 7here has been an increase r�f criminal aciivity occurring <br /> on site. The proposed fence will increase security on site �s well as provide a distinction <br /> between the hotel and the single-family residences surrounding the site. <br /> The property has an existing one and a half foot tall fence located on top of an exisiing <br /> one and a half foot tall retaining wall in the exact location of the proposed fence. The <br /> applicant would remove the existing fence and construct the six foot tall fence on top of <br /> the existing retaining wall. There is an existing six-foot tall chainlink fence along a <br /> portion of the southern property line. The Lombard frontage is heavily vegetated with <br /> Arbor Vitae, wliich have begun to form a dense hedge. Some of the plant material within <br /> the hedge has begun to die off and show signs of distress. <br /> FINDINGS: The proposed fence would be a six-foot tall chainlink fence constructed on <br /> top of an existing retaining wall running along the western property line and a portion of <br /> ihe northern property line. <br /> DECISION: The Planning Director has determined to approve the application for the <br /> fence modificalion based on the following condiiions being met: <br /> . The maximum height of ihe fence should not exceed six feet above the existing <br /> retaining wall. <br /> . The owner of the property shall cut the vegetation along the Lombard frontage <br /> back to a maximum height of six feet above the existing retaining wall, in line with <br /> the height of the proposed fence. The vegetation shall be maintained at this <br /> height as long as the present use exists on site. <br />
