On August 7, 1998 a Notice and Order of the City of Everett Building Official <br /> (hereinafter"Notice and Order") was issued and served via certified mail upon Jeffrey <br /> Puthoff, Robert Luson, American Residential Mortgage Corporation, Household <br /> Finance Corporation and the State of Washington. <br /> 6. Service of the Notice and Order by ceRified mail to ICA Mortgage Corporation was <br /> attempted but unsuccessful. <br /> 7. On August 7, 1998 the Notice and Order was posted upon the subject property. <br /> S. On August 7, 1998 the City of Everett ordered the building vacated. <br /> 9. The Notice and Order requires that the building shall either be demolished or repaired <br /> in accordance with all current building codes and all other applicable City of Everett <br /> codes, and gives required dates for securing permits, physically commencing work <br /> and completing tivork. , <br /> 10. The Notice and Order provides that any person having any record titfe or legal interest <br /> in the building may appeal fr�m the Notice and Order within thirty(30) days of <br /> service of the Notice and Order. <br /> 11. RobeR Larson filed an appeal with the Building Official on September 2, 1993, which <br /> was within thr thirty-day appeal period. <br /> Conclusions of Law: <br /> 1. Pursuant to Sections 16.12.040 and 16.08.030 of the Everett Municipal Code the <br /> Board of Review has jurisdiction over this appeal. <br /> 2. The building situated upon the propcRy located at 2501 Lombard Avenue in Everett, <br /> Washington is residential. <br /> 3. Conditions exist at the building that are in violation of the Uniform Housing Code, as <br /> adopted by the City of Everett, and render the building unsafe, dangerous or <br /> haz��dous. Said conditions are set out more fully in the Notice and Order, which was <br /> admittcd into evidence as Exhibit No. <br /> 4. Conditions exist at the building that are in violation of the Uniform Code for the <br /> Abatement of Dangerous Buildings, as adopted by the City of Everett, and render the <br /> building unsafe, dangerous or hazardous. Said conditions aze set out more fully in the ' <br /> Notice and Order, which was admitted into evidence as Exhibit No. � <br /> 5.
