J. Munson <br /> Iat 3322 Lombard Ave. , hereinafter referred to as "Applicant," the Board of <br /> IAdjuetment, following a public hearing on said application held on Jan. 7 , <br /> i� <br /> � 1985, and further having reviewed all testimony, makes the following Findings, � <br /> � n <br /> il Conclusions, and Order: � <br /> � FINDINGS AND CONCLUSIONS: <br /> I' 1. That there have been exceptional or extraordinary circumstances or "� "� <br /> conditiona applying to the sub�ect proper[y or as to the intended use ~"jy <br /> ' thereof that do not apply generally to other properties in the same � �'� <br /> � vicinity or zone. <br /> � <br /> I a. Finding: Tha applicant owns a parcel of property at 3322 Lombard � <br /> Avence. The lot is a 50' x 120'. The property is zoned R-4 � <br /> which allowe 58 units per acre. The undezground parking is � z <br /> proposed to the north prnperty line. Decks would be no greater � � <br /> � than roof overhanr. <br /> � N;i <br /> i b. Conclusion: The variance would allow adequate turning radius for� <br /> � underground parking. The decks would provide outdoor space andi o � <br /> the canopy would allow a covered walkway. � <br /> H <br /> � <br /> 2. That euch variance ie neceaeary for the preservation and enjoyment of a � <br /> subetantial property right of the appellant poasesaed by the ovners of � <br /> other properties in the same vicinity or zone. : � <br /> a. Finding: The applicant's property is located in the R-4 zone. <br /> The R-4 one allowe 58 units pex acre. � <br /> i <br /> " b. Conclueion: It is difficult to develop to R-4 density with a SOj � <br /> x 120 1ot. <br /> H <br /> N <br /> 3. That tt�e authorization of such variance will not be materially � <br /> I 3etrimental to the public velfare or injurious to property in the � <br /> vicinity or zone in which [he property is located. <br /> ia. Finding: The underground parking will go [o the north property <br /> line. The main structure will meet setback requirements. <br /> b.
