WITNESSETH <br />WHEREAS, the undersigned is (are) the owner(s) of or has (have) a <br />substantial beneficial interest in the real property described <br />above; and <br />NOW, THEREFORE, OWNERS(S) AGREE(S) AS FOLLOWS: <br />l.Owner(s) agree that the single family residence shall not be <br />used for any purpose which is not in full compliance with the <br />conditions of this covenant and with all City of Everett zoning <br />and building regulations. <br />2.Owner(s) agree that the internal connection(s) between all <br />living spaces within the single family dwelling shall remain and <br />meet City of Everett building regulations. <br />3.Owner(s) agree that the occupants of the single family dwelling <br />shall meet the definition of family as defined in the City of <br />Everett zoning code. As of April 1, 2004, family means any number <br />of persons related by blood, marriage or legal adoption and <br />including foster children and exchange students living together <br />as a single housekeeping unit. Family also means the following <br />when living together as a single, net -for -profit housekeeping <br />unit: <br />a)A group of not more than four related and unrelated adults and <br />their minor children, but not to exceed a total of eight related <br />and unrelated persons; <br />b)Not more than eight disabled persons, whether adults or minors, <br />living together in a consensual residential living arrangement, <br />but not to exceed a total of eight persons. <br />4.Owner(s) agree that a violation of this covenant constitutes a <br />violation of the City of Everett's zoning code and/or other City <br />regulation(s). <br />5.Owner(s) agree to waive any right to assert any claim related <br />to any loss or damage to people or property either on or off the <br />herein described property resulting by reason of or arising out <br />of the permission granted by the City of Everett to place, <br />construct and maintain the secondary kitchen(s) as authorized <br />herein and agree to indemnify (including reasonable attorney's <br />fees) and hold the City, its officers, employees and aqents <br />
