HOLD HARMLESS AGREEMENT FOR SEWER CONNECTION VARIANCE THIS AGREEMENT entered into this 20th day of March 19 95 , by and between the City of Everett, a municipal corporation under the laws of the State of Washington, hereinafter referred to as "City," and PattiC: Caudle , hereinafter referred to as "Owner." WITNESSETH: WHEREAS, Owner owns property at 3505 Lombard Everett, Washington, which is located in the County of Snohomish and legally described as follows: Lot 3, Block 857, Plate of Everett Tax I.D. #4373-857-003-0001 ; and WHEREAS, Owner desires to Convert an existine sinel e family dwelling into a duplex. ; and WHEREAS, EMC 14.08.180(I) authorizes the City Engineer to waive strict compliance with the provisions of EMC 14.08 when he deems physical conditions render compliance impracticable provided the Owner agrees to save harmless and indemnify the City; and WHEREAS, Owner requests a variance to Continue to utilize the existing 4" side sewer rather than.reconstruct the side sewer as a 6"_diameter from the building to the'sewer_main, whereas, the owner'a�rees.to repair/replace side -from the building to the sewer main if in the future_ this becomes necessary. Sear_, ; and WIIEREAS, in lieu of being required to slake the necessary physical changes to accommodate the provisions of EMC 14.08, which the City Engineer finds renders compliance impracticable, Owner agrees to save harmless and indemnify the City;
