HOLD HARMLESS AGREEMENT <br />FOR SEWER CONNECTION VARIANCE <br />THIS AGREEMENT entered into this 20th day of March <br />19 95 , by and between the City of Everett, a municipal corporation under the <br />laws of the State of Washington, hereinafter referred to as "City," and <br />PattiC: Caudle , hereinafter referred to as <br />"Owner." <br />WITNESSETH: <br />WHEREAS, Owner owns property at 3505 Lombard <br />Everett, Washington, which is located in the County of Snohomish and legally <br />described as follows: <br />Lot 3, Block 857, Plate of Everett <br />Tax I.D. #4373-857-003-0001 <br />; and <br />WHEREAS, Owner desires to Convert an existine sinel e family dwelling <br />into a duplex. <br />; and <br />WHEREAS, EMC 14.08.180(I) authorizes the City Engineer to waive strict <br />compliance with the provisions of EMC 14.08 when he deems physical conditions <br />render compliance impracticable provided the Owner agrees to save harmless and <br />indemnify the City; and <br />WHEREAS, Owner requests a variance to Continue to utilize the existing <br />4" side sewer rather than.reconstruct the side sewer as a 6"_diameter <br />from the building to the'sewer_main, whereas, the owner'a�rees.to repair/replace <br />side -from the building to the sewer main if in the future_ this becomes necessary. <br />Sear_, <br />; and <br />WIIEREAS, in lieu of being required to slake the necessary physical changes <br />to accommodate the provisions of EMC 14.08, which the City Engineer finds <br />renders compliance impracticable, Owner agrees to save harmless and indemnify <br />the City; <br />
