City of Everett Planning Department <br />City Hall <br />Everett. Washington <br />S <br />VARIANCE PROCEDURE <br />The City of Everett Board of Adjustment is authorised by law to conduct hearings <br />and make findings and determinations therefrom on applications for variances <br />from the terms of the Zoning Code. In granting such variances the Board is <br />required to consider each of the following determinants: <br />1. That because of special circumstances applicable, to subject <br />property, Including site, shape. topography, location, or <br />surroundings, the strict application to the Zoning Code is found <br />to deprive property of rights and privileges enjoyed by other <br />properties in the vicinity under identical zone classification. <br />Z. That the granting of the variance will not be materially detrimental <br />to the public welfare or injurious to the property or improvements <br />in the vicinity of a zone in which subject property is located. <br />3. That the denial of such variance request would continue or result <br />in an unnecessary hardship to the property owner, the cause of <br />which was beyond his control. <br />4, That any variance granted shall be subject to such conditions as <br />will assure that the adjustment thereby authorized shall not constitute <br />a grant of special privileges inconsistent with the limitations upon <br />other properties in the vicinity and zone in which the subject property <br />is situated, <br />The action by the Board of Adjustment on applications for a variance is final and <br />conclusive, unions the original applicant or an adverse party files an appeal to <br />the Superior Court for a Writ of Ceriorari, a Writ of Prohibition, or a Writ of <br />Mandamus. The filing of such appeal shall stay the effective date of the order of <br />the Board of Adjustment until such time as the appeal shall have been adjudicated <br />or withdrawn. <br />REOUIREMENTS FOR FILING <br />1, Completion of a variance application force. <br />2, Completion of a PLOT PLAN (to a scale not less than 1" = 100 ft.. } to clearly <br />show the dimensions of the property, the location of existing and proposed <br />buildings, signs, curbs, etc. , and the permanent measurements. <br />3. Filing fee of $15. 00., <br />4. PHOTOGRAPHS of the property involved on a scale large enough to illustrate <br />the subjects under discussion are always helpful to the Board of Adjustment <br />and are suggested as exhibits with this application.. <br />n <br />
