This Agreement is made by and between Homewood Development, Inc. ("Homewood"� who alung with its succe�sors and assigns as to Parcel A are collectively referred to as "Parcel A Owner") and A6ode, Ltd. ("Abode"� who along with it.s successors and assigns as to Parcel 8 are collectively referred to a�� "Parcel B Clwner"). 2, Homewood is the owner cfi Parcel A more particularly described in Exhibit A attached hereto and incorporated herein hy reference. 3. A6ode will become the owner of Parcel H more particularly described ;n Exhibit A attacY�ed hereto and incorpordted herei�i by reference, on which Parcel B Abode intends to construct a residential pr�.ject. 4. The Parcel A Owner hereby grants to the Parcel B Owner the right (at the sole cost and expense of the Parcel B Ownerl to i�stall and thereafter maintaiii and repair landscaping and ar, entry sign on a portion of Par�el A as more particularly depictcd on Exhibit 8 atta�lied hereto and incorporated herein by reference. 5. Said landscaping and entry sign sha11 initially be installed by the Parc=1 B Owner on or before a date one (11 month from the date �'°' `a chat the !ast certificate of occupancy is issued in connection with �*��.. the residential pro]ect to be constructed on Parcel B. 6. Following initial installation, the Parcel B Owner shall thereafter continuously maintain and repair at the Parce: B Owner's sole expense said landscaping and entry sign to substantially the same standards that existed upon initial installation and in a manner acceptable to Parcel A Owner. If the Parcel H Owner defaults in maintaining electetolterminate la�dscaping and entry sign, the Parcel A 9wner may the riyhts of the Parcel B Owner under this Agreement upon the tailure of tY�e Parcel B Owner to cure such default within thirty (30) days following Parcel H Owner's receipt of a written notice from the Parcel A Owner describing the nature oi such default; provided, that if because of the nature of the default or for reasons beyond the reasonable control of the Parcel 8 Owner such default can not be cured within said 30-day period then by mutual agreement with Parcel A owner said 30-day period may be extended. ��r �� .
