Lo'.f�4..-�%i.-/� !�-.�LS <br />j�rozc rc.�re„; �• �oy-�...•r_ ) f <br />� �`. <br />. ��% r ti.. -. � <br />Dear Citizen: <br />NOTICE OF CITY ACTIOiI <br />PLANNIMG DIRECTOR DETERMINATION <br />INTROOUCPI08: The City of Everett Planninq Department has <br />received an application from Paul 3tronime, represented by <br />Lovell-Sauerland and Associates �19400 33rd Ave W., Suite <br />200, Lynnwood, �Jashinqton, 98036), for a"Reasonable USP <br />Determination" for a proposed sinqle family residence on Loc <br />18 of the Beverly Acreage Tracts (Tax /� 3920-000-18-0100) as <br />provided for under Section 37.050 of the Environmentally <br />Sensitive Areas OrdinancP (ESA). The Planning Director is <br />authorized to approve a"reasonable use" when standards <br />required by the ESA section of the zoning code cannot be met <br />by the praposed use. ESA section 37.O50.D.1 of the zoning <br />code authorizes the Planning Director to approve variances <br />from other standards (e.g. front/side/rear setbacks) of the <br />zoning code in orde-r to mitigate impacts of a"reasonable <br />use" upon an ESA area. Section 37.050.U.2 also allows the <br />Planning Director to reduce ESA buffer setbacks helow the <br />minimum standards set forth in the ordinance. The <br />"reasonable �tse" can only be granted if the Planning <br />Director determines that the series of findings under <br />section ]7.050 B.1-5 are met, including findings that the <br />there "is no reasonable use or feasible alternative to the <br />proposed project" and that the project "mitigates impacts on <br />the environmentally sensitive areas to the maximum extent <br />possible." <br />Usinq Review Process II.B, the Planninq Director is <br />authorized to "....approve, disapprove or approve with <br />conditions the use proposed by the applicant" (Subsection <br />42.1o0.B). If no appeel is filed in response to th[: <br />Planning Director's determination, the decision will be <br />considered final. If an appeal of the decision is filed, <br />such an appeal must be submitted to the City's heci�•ing <br />Examiner. As a property owner within 3oo feet of the <br />subject property, this notice is to inform you that the <br />Planning Director has issued a det.ermination on the proposed <br />action as described helow. <br />SUI�MAR`[ oF DECISION: The Planning Director has determined <br />that the proposed reasonable use, as conditioned, is <br />consistent with the requirements of section 37.05o.B and is <br />
