WHEREAS, the undersigned Grantor(s)/Covenantor(s) is/are the <br />owner(s) of or has (have) a substantial interest in the real <br />property legally described above ("Property"); and <br />WHEREAS, Owner(s) applied to the City of �verett for permission <br />to construct an attached accessory building that would be <br />ac�e�sory to single family use; and <br />WHEREAS, the Grantee/Covenantee, the �ity of Everett, ("City") <br />has a substantial interest in the :afe and effective use of <br />lands within its borders and in the �iealth, safety and welfare <br />of its citizens; and <br />WHEREAS, the Planning Director has the autt�ority to allow <br />attached accessory buildings to exceed fi`teen feet in height <br />subject to the provisions of EMC 19.7; and <br />WHEREAS, pursuant to EMC 19.7, the applicant made application <br />to tha City seeking the construction of a detached accessory <br />building to a single family residence that would exceed fifteen <br />feet in height within the 20-foot rear setback; and <br />WfiEREAS, the City of Everett Planning Director has appr��ved <br />said application subject to the applicant complying with all <br />condit.ions of approval and recording a covenant acceptable to <br />the City Attorney's Office per the provisions of EMC 19.7; and <br />j�EFtEAS, before the City will. issue any permit or approval for <br />the constriiction of an accessory buildi.ng to a siiigle family <br />residence that would exceed fifteen feet ir. height, this <br />Covenant must be �igned, acknowledged and recorded in the <br />records of Snohomish County as a restrictive covenant, <br />restricting use by placing conditions on the permission to <br />ccnstruct said attached accessory buiiding; and <br />WIiEREAS, this Covenant concerns t-he Grantor/Covenantor's use, <br />occupation, enjoyment, or development of the Property and <br />benefits the City as Grantee/Covenantee. This Convenant is <br />intended to bind successors and assigns and run with the land; <br />NOW, THEREE <br />occupation, <br />£ollows: <br />RE, Owner(s) a.?ree(s) to abide by restrictions on <br />use, enjoyment an� development of the Property as <br />1.Owners(s) agree to abide by the conditions of approval as set <br />forth in the Planning Director's Decision dated the 2nd, day of <br />August, 2007 autl;orizing the placement of the d�tached <br />�/7 <br />
