Thiq al,ey is a public right-of-way dedicated for the use of the public by the original platters of the property and according to our records, the City ims never relinquished it's right to administer the use of this alley by the public. Fencing tiie alley for the exclusion of another abutting owner, who has an equal right to use the alley is not permitted. The City has no desire to create a situation that will produce ill will in a neighborhood, but neither can we allow one citizen preference over another. The City would prefer that the neighborhood (affected neighbors) cooperatively resolve the use of unimproved alley ways to the satisfaction of all parties. We request that you and your affected neighbors attempt to come to an agreement concerning this issue. if all parties are unable to mutually agree, you will be required to relocate your fence.
