Box 25549 <br />Seattle, WA 98125 <br />Subject: Claimant: George Winkles <br />6-4883 <br />Dear Mr. Spearman: <br />everett <br />the Evergreen <br />�m, oF <br />everett <br />Fcauc vo�..; oen.�rn�e�,r <br />a_::ce��asrae=_r <br />E;E�=-- ��:.s�����,ev <br />983pt <br />On April 22, 1986, an application was submitted to the City of Everett on <br />behalf oP Mr. George Winkles by Cascade Construction Co., Inc. to construct a <br />single family residence. <br />A plot plan was submitted with the application that indicated the minimum yard <br />setback of five (5) feet adjacent to the east property line. During the plan <br />review it was noted that the setbact should be six (6) feet, this was in <br />error and if a permit would have been issued this error would have been <br />corrected and the minimum setback would have remained at five (5) feet. <br />The statement oP Mr. Winkles that the City claims 7 feet of said property for <br />drainage is not quite accurate, as .the City does not have an easement over <br />this property and the drainage that is spoken of is a natural drainage <br />course. Mr. Dan Mathias of the Public Works Department, o�i two occasions has <br />attempted to inform Mr. Winkles oP this and also informed Mr. Winkles that he <br />can put this drainage course in an adequate size culvert. <br />If the drainage course were placed in an adequate culvert, the::e is the <br />possibility that this area could be utilized for his driveway. <br />After a visual inspection oP the proposed building site, we can not find any <br />evidence of any preparation of the site for construction. <br />Also, as no permits have been issued by the City of Everett, there has been no <br />authorization by the City of Everett to proceed. iherePore, the applicant or <br />his contractor has done so at his own risk. <br />
