Our records do not in- dicate that final inspections have been made or occupancy has been authorized by th�.s offic�=_. Section 304 (d) of the Building Code raquires that final inspection be made after a building is completed and ready fcr occupancy. Section 306 (c) of the same code provides that after the final inspection is made and the bui].ding is found to comply with rhe code, the Building Official sha11 issue a Certification of Occupancy. I'� is evident that tliis has not b��en the case at 3 Madison Avenue. It appears that you have voluntariiy nermitted occupancy in violation of the Auilding Code. Section 202 (f) of the Code states: "[•7henever any structure is being used contrary to the provisions of this Code, the Building Official tnay order sucl, use discontinued and the structure, or portiun thereof, vacated b}• notice served on any p�rson causing such use to be continued. Suc,h person shall die�continue the use within 10 days af��r receipt of such noti-e or make the structure, or portion tliereof, comply with the requirements of this Code; provided, hoc•rever, that in the event of an unsafe buildiny Section 203 shall apply". Section 205 of the Code provides for penalties in case of violations to the Code. I also understand that these occupancies are in violation of the PRD. In ca3es of violations �f the PRP, the City Council may order the pr�misea vac'ted.
