U�C! `T , p�= i�L/!r'S� �il! _ i/ <br />, Z oi i . <br />L.���� . <br />� <br />�: : . <br />/3�ou< 2'� iGAr u!= Low,�.�L <br />,Q�'-'c�i75 0�= SNJ//OOY.siY— <br />�.�' '•" �, WHEREAS, Owner has applied for a permit from the City of Everett which <br />'/ l^n�er Ordinance No. 555-78 and Ordinance No. 665-SO require certain improve- <br />ments to be made to public rights of way as a condition to issuance of certain City <br />permits; said Ordinanees allow that the Citv Engineer ❑iay accept a covenant <br />consenting to the formation of a local improve;nent district in lieu of having Owner <br />construct and install the required public improvements when, in the opinion of the <br />City Engineer, certain aetuul impr�vements are not desirable due to known or <br />perceived physical problems or the need for more com�rehensive improvements; <br />WHEREAS, Owner's property and the adjacent public rights of wey have <br />been determined to require a covenant consenting to the formation of a local <br />improvement district rather than having Owner make specific improvements. _ <br />NOW, THEREFORE, in consideration of issuance of applicable City <br />permit(s) pursuant to Ordinance No. 555-78 und Ordinance No. 665-80 and in lieu <br />of certain public right of wuy improvements Owner consents to the formation of a <br />local improvement district hereafter formed by the City or its successors or other <br />property owners for the public improvement of: <br />/' //-N i or lu�l� .'J� n.✓t._ /�/�1i�./ s i,—_ <br />or a portion thereof including street improvements defined in Ordinance Nos. <br />555-78 and 665-80 to include: <br />The installation of all public fncilities required to improve the street <br />to .City design standards including grading, drninage, pavement, <br />curb/gutter, sidewalk, street lights, traffic signals and other neces- <br />sary appurtenanees. Such street improvements shall not be limited to <br />the half street abutting the property; for example, where no per- <br />manent street improvement existr.d, the street improvement shall be <br />e�ctended beyond the centerlinr. n,sufficient distance (1D ft. minimum) <br />to permit safe movement of trnffic. <br />This Covenant consenting t:� ihe f�rmation of a Iocal improvement district <br />applies (and precludes legai prote�Q) only to the formstion of a local improvemenb <br />district, Owner executing tt,i; document retuins its, his/her or their rights under <br />]aw to provide input or to mnke objection to the scope of the proposed public <br />improvements to be accomplished by such loc¢1 improvement district inciuding <br />nature and type of improvements es well as the proposed or final benefits nnd <br />assessment ther�for. <br />The City shall deliver a si�ned release of this Covenant to Owner after <br />completion of public improvements as described hereinabove through the formution <br />of a local imprcvement district and nfter trunsmittnl of the tinal ussessment role <br />to the County of Snohomish pursuant to law. The City muy not utilize this <br />Covenant for the formation oi more than one (1) local improvement district. <br />This Covenant consenting to the formation o£ u tocel improvement district. <br />shall be a covennnt touching, concerning nnd running with the land and shall be <br />binding on Owner's heirs, assigns or successors in interest. <br />-1- <br />� 8-80 <br />
