Your approved plans specif ically state "asphalt conerete", with an approved "cross section" for rnnstruction purposes. No "hammerhead" was shown nor approved, yet such a hammerhead has becn constructed as an integral ccmponent of your alley improvement. You further faileo to call for inspeciions on either your drainage or alley improvements, thus the City has no knou�ledge or record ef your construction methods, compaction of fill material, Installatlon, or routing of the installed drainage pipes, nor concrete surface constructlon. We aze faced with tv.�o alternatives: 1. You will remove the present concrete alley and reinstall asphalt concretc according to your approved plans and specifications. 2. You will petition the City Council for vacation of the entire alley rigiit- of-�ray and assume private liability for maintenarce of the installed Impr�ve- ments. 1�vish to specifically point out that no Certificate of Occupancy viill be issued for th� subject structure prior to the total solution oi this proolem. I wouid also suggest th:.. you refresh your memory regarding procedures for construction and inspectlon within the City. ]t is difiicult to comprehend that e builder with your extensive record within the City would not Imoa� that inspections were required for ail n�ork performed in or upon the puhlic right-of-way or to the public utllity systems.
