WASNINGTON <br />DO2o1 <br />The Public Works Department received copies of the invoices and letter <br />from Associated Sand $ Gravel yesterday. <br />The information supplied by you adequately addresses the issue of materials <br />useu; however, the stability of the material, as indicated Uy the letter <br />and specifications, is totally dependent upon the placement and compaction <br />of the material. <br />In your on-site meetings with John Patzold and Lon �fayUerry oF this <br />department you �aere told that the City's concerns ivere the issues of <br />liaUility and maintenance. In a discussion �aith Jim Iles of the City <br />Attorney's Office, he inai:ated to me that a resolution satisfactory <br />to th� City has not been reached with your attorncy. Therefore, at this <br />time, the City has no alternative but to require: (1) that you provide <br />test results by an engineering geologist indicating that the material <br />�aas placed and compacted in a satisfactory manner, or (2) rcmove the <br />improvements and replace them according to tlie approved plans with the <br />City Inspector's concurrence tliat tl�e improvements are constructed by <br />approved construction techniques. <br />If you nave any further questions regarding this matter, please call me <br />at 259-8811. <br />Sincerely. <br />DIARVIN C.
