<br />as Principal (hereina ter referred to as "Principal"), and
<br />RELIANCE INSURANCE COMPANY , a corporation organized and existing
<br />under and by virtue'o the aws o Pennsylvania ,authorized to
<br />do business in the State of Washington, as Suret�� (hereinafter referred to a
<br />"Surety��), are held and fir•mly bound unto the City of Everett, a municipal
<br />corporation under the laws of the State cf Washington (hereinafter referred to
<br />as "City'�), as Obligee, in the penal sum of TWO HUNDREO NINETY SEUEN THOUSAND

<br />WHEREAS, Principal has agreed to construct the following imp�•ovements in
<br />the City of Everett, State of Washington: Public ortion of utilities for
<br />Hunter's Pointe Apartments, 9009 West Ma Drive. Everett. WA 9 2 8
<br />WHEREAS, Principal has agreed to construct the improvements at the
<br />following location which is located in the City of Everett, County of
<br />Snohomish, State of Washington, and is described as follows:
<br />Hunter's Pointe Apartments, 9009 West Mall Drive Everett WA 9 2
<br />; and
<br />kHEREAS, the City is requiring the Principal to provide a bond
<br />guaranteeing the construction of said improvements.
<br />NOW, THEREFORE, THE CONDITION OF THIS OBIIGATION IS SUCH, that if the
<br />said Principal shall construct, or have constructed; on or before the lst
<br />day of March , 1991, or at such earlier date when requested to do so by the
<br />City, the improvements herein described in accordance with approved plans and
<br />in conformance with the City standard specificatiens, to the satisfaction of
<br />the City Engineer, and shall save the City harmless from any loss, cost or
<br />damage by reason of its failure to complete said improvements, then this
<br />obligation shall be null and void; otherwise to remain in full force and
<br />effect.
<br />In the event the City is required to institute litigation to obtain
<br />performance pursuant to this bond, Principal and Surety agree to pay all
<br />reasonable attorney's fees and.costs which are incurred by the City.
