r . � � _ By converting the structure frorn a single-family residence into a rooming house without a Use Permit and by allowing sleeping rooms to be occupied with locking systems that would prevent an occupant from escaping in the event of an emergency, the Respondent have violated Internationa� Residential Code 2009 105.1; Everett Municipal Code 19.41.070 and Internationai Property Maintenanc.� Code 2009 702.3; 108.1.182. ORDER Based on the Findings of Fact and Conclusions of Law as stated above, the following Order is issued: 1. The Respondent shall legally rsmove all tenants from the property that are occupying sleeping rooms that do not meet the requirements of the International Residential Code. They shall refrain from utilizing any spaces within the property as sleeping rooms that do not meet the requirements of the International Residential Code. The removal of said tenants shall be in full compliance with all provisions cf the Washington State Landlord-Tenant Act, RCW 59.18. 2. The Respondent shall apply for and obtain all of ihe necessary and required permits to bring the property into compliance with the Everett Municipal Code. This must ba completed and inspected and approved, by the City's Building Division, by Januar,y 31, 2012. 3. The Respondent is fined $1,500.00 for these violations but suspend $1000.00. Of this total fine $1000.00 will be suspended. On February 9, 2012, a hearing may be held to determine if the fine remainder of the fine is permanent. The fine is payable to the Everett City Clerk's Office, located at 2930 Wetmore Avenue, Suite #100, Everett, WA 98201, no later than July 1, 2011. 4. The Respondent shall not violate any ordinance set forth in EMC 1.20.020 or any ordinance or regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as 4he enforcernent procedure for said regulations or ordinance, for the next twent; •four (24) months. 5. This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing. 6. If the Respondent fails to abate the identified violations as directed by this Order, the City of Everett is authorized to undertake and complete the abatement in conformance with the provisions of the Everett Municipal Code, Chapter 1.20, at the full expense of the owner and the City may act without further order or direction of the Violations Hearing Examiner. 7. Any appeal of this Order must be filed in Superior Court and be made within twenty- one days of the issuance of this Order and comply with the procedures set forth in Chapter 36.7UC of the Revised Code of Washington.
