r . � � _ <br /> By converting the structure frorn a single-family residence into a rooming house without <br /> a Use Permit and by allowing sleeping rooms to be occupied with locking systems that <br /> would prevent an occupant from escaping in the event of an emergency, the <br /> Respondent have violated Internationa� Residential Code 2009 105.1; Everett <br /> Municipal Code 19.41.070 and Internationai Property Maintenanc.� Code 2009 <br /> 702.3; 108.1.182. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, the following <br /> Order is issued: <br /> 1. The Respondent shall legally rsmove all tenants from the property that are occupying <br /> sleeping rooms that do not meet the requirements of the International Residential <br /> Code. They shall refrain from utilizing any spaces within the property as sleeping <br /> rooms that do not meet the requirements of the International Residential Code. The <br /> removal of said tenants shall be in full compliance with all provisions cf the <br /> Washington State Landlord-Tenant Act, RCW 59.18. <br /> 2. The Respondent shall apply for and obtain all of ihe necessary and required permits <br /> to bring the property into compliance with the Everett Municipal Code. This must ba <br /> completed and inspected and approved, by the City's Building Division, by Januar,y <br /> 31, 2012. <br /> 3. The Respondent is fined $1,500.00 for these violations but suspend $1000.00. Of <br /> this total fine $1000.00 will be suspended. On February 9, 2012, a hearing may be <br /> held to determine if the fine remainder of the fine is permanent. The fine is payable <br /> to the Everett City Clerk's Office, located at 2930 Wetmore Avenue, Suite #100, <br /> Everett, WA 98201, no later than July 1, 2011. <br /> 4. The Respondent shall not violate any ordinance set forth in EMC 1.20.020 or any <br /> ordinance or regulation that identifies the enforcement procedure described in <br /> Chapter 1.20 EMC as 4he enforcernent procedure for said regulations or ordinance, <br /> for the next twent; •four (24) months. <br /> 5. This written Order shall be controlling over any conflicts with oral Orders issued at <br /> the Public Hearing. <br /> 6. If the Respondent fails to abate the identified violations as directed by this Order, the <br /> City of Everett is authorized to undertake and complete the abatement in <br /> conformance with the provisions of the Everett Municipal Code, Chapter 1.20, at the <br /> full expense of the owner and the City may act without further order or direction of <br /> the Violations Hearing Examiner. <br /> 7. Any appeal of this Order must be filed in Superior Court and be made within twenty- <br /> one days of the issuance of this Order and comply with the procedures set forth in <br /> Chapter 36.7UC of the Revised Code of Washington.
