( . . <br /> � <br /> PLANNING DIRECTOR DETERMINATION <br /> Review Process II #01-013 <br /> INTRODUCTION: The City of Everett Planning Department received an application from <br /> Jake Mitchell, 4918 W View Drive, Everett, WA 98203, to construct a new detached garage <br /> building at 1516 Hoyt Ave. There is an existing detached garage on the property that has <br /> non-conforming setbacks of 1 foot 6 inches from both noRh nd south side property lines. The <br /> applicant proposes to construct a new garage with the same setback from the south side <br /> property line. All other setback requirements will be met. <br /> The existing garage structure was originally constructed in 1913 according to the Snohomish <br /> County Assessor's records and has been certified as a legal non-conforming structure <br /> (NCB#01-010). Section 38.040 ailows far the Planning Director to permit ?he expansion of a <br /> structure which does not meet required setbacks or height, provided that the expansion does <br /> nct make the setback or height more nonconforming; that the expansion complies with all <br /> other requirements of the zoning code ordinance; and that the nonconformity has been <br /> certified by the Planning Department. <br /> FINDINGS: The property is located in the R••2, Single Fair,ily Residential Zone. The typical <br /> required setbacks from the interior side property lines is 5 `eet. The existing garage is loca:ed <br /> only 1 foot 6 inches from both the north and south sioe property lines. It was originally <br /> constructed in 1913 according to the Snohomish County Assessor's records. The zoning code <br /> requirements for building setbacks for structures from side property li�es became effective <br /> December 1, 1956. <br /> DECISION: The Planning Director has determined to allow for the proposal with the following <br /> condikions: <br /> 1. All necessary building permits are to be obtained from the City of EveretYs Building <br /> Department. <br /> Right to Appeal: The applicant or owner of property located adjacent to tiie subject property <br /> or any property owner �vho deems himself aggrieved and wiil thereby suffer a direct impact <br /> from the proposal may appeal the Planning Directors determination as to whether or not the <br /> proposal should be permitted. Any such appeal must be filed within fourteen (14) calendar <br /> days of the date specified below. Appeal forms are available from the Planning Department <br /> and must be submitted along with the required filing fee.
